Terms of Service

These Terms of Service ("Terms") govern your access to and use of akFISHinfo (the "Service"), operated by ("we," "us," or "our"), a sole proprietor based in Fairbanks, Alaska.

By creating an account, starting a free trial, or subscribing to the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older.

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. We will make reasonable efforts to notify registered users of material changes.

akFISHinfo monitors a designated email inbox for opening announcements issued by the Alaska Department of Fish & Game ("ADF&G") for Prince William Sound commercial salmon fisheries. When an announcement is received, the Service uses automated AI-assisted parsing to extract district information, gear types, and open/close windows, and delivers Telegram alerts to active subscribers.

The Service is an information delivery tool, not an authoritative source of fishing regulations. All alert content is derived from official ADF&G communications. akFISHinfo does not generate, author, or modify regulatory information.

The Service is intended to provide timely access to information that ADF&G has already made public. It is not a substitute for direct monitoring of official ADF&G channels.

The map interface may request access to your device's location to center the map on your current position. Location data is used only within your browser and is not transmitted to or stored on our servers.

Free Trial. New subscribers may access the Service free of charge for seven (7) days. One trial is permitted per linked Telegram account. Trial access is subject to all other provisions of these Terms.

Current Subscription Rates. The following rates apply to the first 30 subscribers who activate a paid subscription ("early adopter" pricing):

Early Adopter Rate Lock. Subscribers who activate a paid subscription among the first 30 to do so will have their rate permanently locked at the applicable early adopter price shown above for as long as their subscription remains active and in good standing. A lapse in subscription (cancellation followed by re-subscription) forfeits the locked rate.

Standard Rates. After the first 30 subscriber slots are filled, new subscribers will be charged at the then-current standard rates, which are: $50.00 biweekly, $84.00 monthly, and $400.00 per season (May–September).

Billing. Subscriptions are billed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable rate until you cancel. All amounts are in U.S. dollars.

Auto-Renewal. Subscriptions renew automatically at the end of each billing period. You may cancel at any time via your account page; access continues through the end of the current paid period.

Refunds. We do not issue refunds for partial billing periods.

Price Changes. For subscribers not subject to an early adopter rate lock, we will provide at least 30 days' notice before any price change takes effect.

Mobile app subscriptions. The akFISHinfo iOS and Android apps are free companion clients to the web service. All subscriptions are created and managed on the web at akfishinfo.com; the apps do not offer in-app purchases. To start, cancel, or change a subscription from your phone, open akfishinfo.com in your browser. Apple is not the seller of any subscription purchased through this Service and has no responsibility for any subscription terms, billing, or refunds.

Apple Standard EULA. If you obtained the iOS app from the App Store, your use of the app is also governed by Apple's Standard End User License Agreement. To the extent these Terms conflict with the Apple Standard EULA, these Terms control with respect to the akFISHinfo Service itself; the Apple Standard EULA controls with respect to your use of the iOS application binary.

Alerts are derived directly from official ADF&G opening announcements and are delivered through one or more channels depending on your account configuration: Telegram direct message (web users who link a Telegram account), Apple Push Notification service (iOS app users who allow notifications), or Firebase Cloud Messaging (Android app users who allow notifications). Subscribers are expected to rely on these alerts as one input into their fishing decisions.

You are responsible for verifying that a fishery is open before deploying gear. akFISHinfo shall not be liable for fines, permit violations, lost catch, vessel damage, or any other loss or consequence resulting from a delayed, inaccurate, incomplete, or missed alert.

By linking your Telegram account to akFISHinfo, you consent to receive direct messages from the akFISHinfo bot. You may opt out at any time by sending /unlink to the bot, by clicking "Unlink Telegram" on your account page, or by canceling your subscription.

akFISHinfo parses and delivers ADF&G announcements as received. The Service does not provide legal advice, regulatory guidance, or fishing recommendations.

ADF&G regulations and opening announcements may contain conditions, gear restrictions, area descriptions, and timing constraints that the automated parser may not fully or accurately capture. The official ADF&G announcement and applicable Alaska commercial fishing regulations are the authoritative sources.

You are solely responsible for compliance with all applicable Alaska commercial fishing regulations, permit conditions, and ADF&G orders.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AKFISHINFO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOST CATCH, VESSEL DAMAGE, FINES, REGULATORY PENALTIES, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF AKFISHINFO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL AKFISHINFO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL FEES PAID BY YOU TO AKFISHINFO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless akFISHinfo and its operator from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

You are responsible for maintaining the accuracy of your account information and for keeping your Telegram account linked. Alerts are delivered to the Telegram account on file. akFISHinfo is not liable for missed alerts resulting from an unlinked Telegram account, disabled notifications, or device issues.

One free trial is permitted per linked Telegram account. Attempts to circumvent this restriction by linking and unlinking multiple Telegram accounts may result in account termination.

Account sharing is not permitted. Your subscription is for your individual use.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You may not:

(a) resell, redistribute, or commercially exploit alert data or any Service output;
(b) use automated means to scrape, harvest, or systematically collect data from the Service;
(c) use the Service to facilitate fishing in violation of any applicable ADF&G order, permit condition, or Alaska law;
(d) attempt to gain unauthorized access to any part of the Service or its underlying infrastructure.

You may cancel your subscription at any time via your account page. Access continues through the end of the current paid billing period.

We reserve the right to suspend or terminate your account, with or without notice, if we reasonably determine that you have violated these Terms or that continued access poses a risk to the integrity of the Service.

These Terms are governed by the laws of the State of Alaska, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts of the State of Alaska.
